Notarial services
As a Liechtenstein notary, I am the holder of a public office, entrusted with state authority and authorized to draw up public deeds. In doing so, I ensure the authenticity, probative value and safekeeping of these deeds. I am bound by law to be impartial and objective and enjoy public trust.
Public” notarization, however, does not mean that notarized documents become publicly known: all Liechtenstein notaries are subject to strict legal obligations of confidentiality. In this context, public signifies that we perform a public task when drawing up a deed.
Public notarization under domestic law
The Liechtenstein legislator has prescribed public notarization for the most important deeds in legal life, such as when forming legal entities (public limited companies), amending articles of association of associations or deeds relating to real property. Such public deeds can be drawn up by me.
I also certify facts and legal relationships that are otherwise legally relevant if there is an interest worthy of protection that they are recorded in a notarial deed and if the notary is aware of their legal significance.
Furthermore, I draw up executory deeds, which have the same legal quality as a settlement reached in court.
Public notarization under foreign law
I also provide public notarization under foreign law so that foreign clients can be best served. This includes the following services:
- Issuance of deeds under foreign law:
Such a deed can be drawn up if the Liechtenstein notary understands the legal acts to be notarized, is able to explain them to the parties, has an overview of foreign law and can thus check the legal transaction to be notarized with regard to its compatibility with foreign law. - Taking affidavits, oaths and comparable forms of declaration:
The same requirements apply here as for the issuance of deeds under foreign law. - Taking unsworn and sworn depositions of witnesses for use or preparation of court custody abroad (pretrial depositions)
Certifications
Apart from the drawing up of public deeds, we also carry out certifications, which include:
- Certifications of signatures and hand signs
- Certification of copies / transcripts / extracts
- Certification of translations
- Date certifications
Fees
The notary has the right to freely negotiate fees. The fee is to be assessed according to the nature and extent of the efforts and the difficulty of the case. The Liechtenstein Chamber of Notaries has issued a fee guideline on the appropriate level of the fee which can be found on the homepage www.notariatskammer.li.
